I checked the German Mission in the US website and there I-797 is not mentioned among the documents permissible as exception for Transit Visa. Best is to call the German Mission and confirm. When I spoke to them it looked that they were already aware of this confusion and gave me a definitive answer that I didn't need the transit visa.

No Not an option at all. I wish there was an option for USCIS/DOS to recapture wasted visa numbers. Same with the PBEC. The only thing that can provide relief to every one is legislative action. Please actively take part in the DC rally to get legislative relief.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
2. Can she use Premium Processing for H1 transfer?

I mailed it to NSC on aug 3rd nothign yet..
Sorry to hear that....Mine is TSC and They receieved my Applications on Aug 13, 2007. But One of My friend Filed with NSC and They receieved his application on Aug 16, 2007. His Check got cleared couple of days before.

I have two Approved I-140s (both filed by same company).
� Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
� Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:

I�ve a serious problem with my D2H. The photometer is not working at all!!!! The top display is showing always �HI� (or a very hi speed when I put the diaphragm at maximum) even with the optics cover closed. I�ve reset (with the green buttons) the camera but the problem persist. I�ve removed the battery > switched camera on > camera off again > insert the battery but no solution.
The ISO value is at 200.
I�ve switched on different positions the metering selector several times� nothing!
I�ve removed the memory card� nothing!
The rest is working perfectly, so I can take pictures with an external photometer (which I don�t have here now) or based on my light condition experience but this is not the point!!! Actually, I usually takes wilderness and travel photography and an external photometer makes me very difficult the practices. In addition, I�m living in Guinee (in the middle of nowhere) at this moment, them there is not Nikon service here of course!!!
Please, any suggestion? Advice?

If someone using company lawyer to file I-485 and other forms, ask this lawyer will he send receipt notices to the applicant or not. Some will get answer that it's company policy not to sent anything to applicants :mad: .

Hi ,
I want to change my wife's H1 to H4.
She got her first approval in oct 2006 and was working as fulltime. after that she coverted to H4 when we visited india. her H4 is valid through oct'09. then we file for her new H1 from company B in march 09 (COS) and she got approval but due to bad market condition she never got project and her consulting company never paid her so she doesn't have any paystubs. My company file for my H1B extension and I got approval.
Now I want to change my wife's status back to h4. I had in impression that she never worked on new H1 so her H1 will not be activated. but I came across some posts and learn that it is automatically activated the day she got her H1B approval.
Now please suggest me what would be the safest way to convert her back on H4 ?
1)File form I-539 without her paystubs using my new 797 document? is there chances of RFE without paystubs? and what could be the next step if RFE comes? can we go to home country and get it done or it will make more complications? and VO will ask more questions because of RFE?
2) go out of county and come back again on existing stammped h4 (I am hoping that will convert her status back to H4)? and then file for I-539 for H4 extension using my new Approval notice? she has canadian PR as well. should she visit canada or india? somehow her I94 on passport has expired in Feb'09 but she has valid I94 on her H1 pitition. should she give her new I94 when going out of country? if she visits canada will they issue her new I94 if she returns back within 30 days?
3) should she go outside country and apply for new H4 using my new approved 797 ?

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.

i did it myself... highly recommend it... unless you have good budget or expect the money to be made back real quick...
in most states, first step is to file the articles of incorporation, once articles are approved, you may have to select a board (if you did not set it up in the articles), record the inc with your county recorder, register the inc with IRS (for fein), open a bank account, if your business is retail, register with the state, get a state id number and thats it...
the long process is making all the decisions... who should be your registered agent, how many shares, what initial equity, what address, who are the board members, what purpose of the company etc...

As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

Hi Guys,
Just some few questions. Me and my wife are in separate H1 visas. I got my 140 and 485 applied thro my compnay and my wife has gotten her EAD and AP. She is thinking of switching jobs now with her EAD. I understand that her H1 status expires if she does that.
Here is my predicament. I know it's far fetched. but wanted to throw it out to get some opinions.
say my wife quits her current job and takes up another position with her EAD and then 6 months down the road i dont get my 140 approved and i'm fired. Here are the list of questions i have
1) the EAD expires october so we have to file the ead around june to get it renewed, will it be valid for the time period it is specified even though i dont have my original job? (i'm planning to apply for my EAD now). i'm hoping i dont get fired by then..
2) Can we invoke AC21 in this situation? will it work?
3) is it too risky to change now or wait till the 140 approved?
4) can the compnay revoke the 140 after 180 days whether it is approved or not? i'm prety positive that they wont..but u never know...
if she dont change her job the whole premise of having the EAD is a joke. she still have to slug it out with her consultant. I know it's all just hypothetical but any suggestions/comments would be appreciated. please throw your thoughts in.

can you reword the title? I am not sure how that title is accurate given the background of how macaca was used: Sidharth (who was born and raised in the US, but is of of Indian origin) was called Macaca by George Allen because of the color of his skin. Getting a GC or not getting a GC does not change the color of one's skin so it does not stop people from calling you a macaca...

I have a very unique problem.
I'm filing 140 and 485 now with my current company (company B). I came to USA in Sep 2000 via company A. I joined current company in May 2003. I did not resign from company A till July 2003 ( was on vacation from company A and got paid).I also got experience letter from company A saying that I worked from Sep 2000 to july 2003
Now in my biographic forms should I declare that I worked in company A from Sep 2000 to May 2003 (or) Sep 2000 to July 2003?
If I put Sep 2000 - July 2003, will I be in a problem? Please advice
Also, I LC just got approved from P-BEC. We dont have the physical copy yet. can we file 140 and 485 without it?
