I am currently on H-1B and filed for Adjustment of Status. I filed my I-485, AP, & EAD in August 2007. I got my EAD and AP in 2007 and it expired last year as well. I did not use the AP. I am with the same employer that filed my green card application. I am continuing on H-1B and did not use EAD.
My H-1B is valid till April 2010. I have not applied for the extension of my EAD & AP. The H-1B stamp on my passport expired in August, 2007. Also, my passport is valid till October 2009. My wife is on H-4 and the visa stamp on her passport also expired in August 2007. Her H-4 is also valid till April 2010. I am planning a trip to India in the coming month.
I wanted to know the process for my travel to India at this time on H status. Should I follow the standard procedure to file for H-1B renewal stamping at Indian embassy in India. Do I need to apply for passport renewal now since I have 8 months before it expires. Is it true that now it takes 4 work days to get the visa stamp in Canada.
Your help in answering this would be really appreciated.

The H-1B quota is slowing reaching its limit. The so-called advanced degree cap is now full and approximately 53,800 cases have been counted against the 65,000 allocated to the regular cap. USCIS has advised that those wishing to be counted against this year's cap should submit their applications as soon as possible.
A lot has been said about how much longer the H-1B quota has lasted this year. There's a been a lot of speculation about the reasons why the quota is still open. It's pretty obvious that the economic situation has led to a reduced number of filings, but less people talk about the other reason. This has increased the number of requests for evidence that USCIS has issued this season as well.
While the open cap provides an opportunity for a late-season submission, H-1B applicants and their employers should be well aware of the scrutiny they may have to endure. I was employed by company A until from 2004 thru May'07 with labor and I140 approved in 2006, I was laid off from Company A in May'07 therefore I joined company B in June (transfered my H1).
In July , Company A agreed to file my I485 under future employment as all the EB catagories became current but I still work for company B (H1 with company B), now since in Jan'08 it will be past 180 days on my 485 application.
Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?
Your suggestions/answers will be appreciated.

I applied for H1b visa transferred in Nov 08 inspite of not having recent pay stubs. After applying transfer, I started working for new employer.
Last week I got query from USCIS asking my latest pay stubs (Oct 08) and yesterday I got Laid off from my new job after working for 4 months (till Feb 09).
My husband is on L1B visa.
In my case
1. Shall I consider transferring to L2? for this do I need to go to my home country (India) for L2 stamp?
2. If COS to L2 is approved, Can I work on my old H1B again if I find an employer who is ready for transfer?
3. If I travel to my home country(India), will my H1B visa be cancelled? as currently i don't have any H1B approval.
4. Whether the Request For Evidence(REF) on my H1B transfer will have any implication on L2 stamping?
Please help ..

I just called USCIS to check the status of my case and the Immigration Officer said it is in EB-1 category. I know my case is EB-2.
I asked the IO to see if i have send any paperwork to rectify their mistake, but she said USCIS will automatically adjust the category whe it picks up the case for review
I am confused. Please Advice

Maybe the EXIF data will be helpful though it's not completely accurate, even though I shoot in manual it will read shutter priority. ISO usually 1600 as Josh stated above.
